The sole issue on appeal is whether Simons demand for a new trial was ineffective because he had it personally delivered to the office of the plaintiff, Richard Engelbrecht, rather than mailing it as prescribed in the statute. Because Engelbrechts receiving notice of Simons demand for a new trial by personal delivery rather than by mail constitutes harmless error, the order is reversed and the matter is remanded for further proceedings.
